When is the trash picked up.

Agile Waste Solution curbside collection program supplies each customer with a 96-gallon poly-cart for their solid waste disposal that will be collected once a week at the curbside.

What will trash service pick up.

AWS will only service the poly-cart labeled AWS, everything must be bagged and placed inside the issued cart. Anything placed beside or outside the poly-cart will not be picked up.

Where do we put the trash cans to be picked up?

Residents are required to roll the containers to the end of the driveway or designated pickup location on collection day.Additional carts are available, if needed, for $15.00 per month. Please contact AWS utilizing their online or mobile app or this Website or call 1 (830) 581-8730 if you would like to order an additional cart. Please review map for service day. Because service begins within 3 days after oder placement.

To make the program successful, the remainder of this information will outline important guidelines for you to follow when using the services available. This will ensure that you receive the best possible service with as little inconvenience as possible.

COLLECTION PROGRAM GUIDELINES:

What time should trash can be set out?

Your trash must be curbside by 5:00 a.m. on your designated collection day inside the provided cart.

Do I have to bag the trash?

All trash must be in a bag contained in the cart issued by AWS and the lid should be closed and ready to go. Any material loose inside or left outside the cart will not be collected. All household refuse should be bagged. Bagging your trash will help to keep the cart clean and sanitary and prevent litter on windy days.

How full can I fill the trash can?

The container will only hold up to 200 pounds. Please do not overload the container.

When I order service am I buying the trash bin?

The carts remain the property of AWS and will be maintained and replaced at no cost to the resident except for damage due to negligence or abuse. Residents will be required to pay for the replacement of any container if the damage is due to their negligence or abuse. Do not take the container with you when you move.

Where do I place the trash can on pickup day?

The placement of your cart is very important, since some of the collection vehicle's are equipped with lifting arm that require a clearance of 3 feet on both sides, and 12 feet overhead. The cart should be no more than 2 feet away from the curb or road edge, and the arrows on the lid must be pointing toward the street, with the hinges facing away from the street. Each cart needs to be placed at least 3 feet from each other for those that have multiple carts.

Place cart no closer than 6 feet from any automobiles and no closer than five feet from any obstruction like mailboxes or fences. We recommend that placement of the carts should be on the opposite side of the driveway from your mailbox.

Residential Trash Collection Service - Terms and Conditions

  1. Services Provided: The customer grants Agile Waste Solutions (AWS) the exclusive right to provide trash collection and disposal services for all non-hazardous solid waste generated at the customer's home address, except for excluded materials as defined in Section 2 below. AWS will provide all equipment necessary for collection, including trash carts and bins, which will remain the property of AWS. While in the customer's possession, the customer is liable for any loss or damage to the equipment provided, except for normal wear and tear. The customer is responsible for safe storage of the equipment and providing unobstructed access on the scheduled collection day. For curbside collection, carts/bins must be placed at the curb by 7 AM on the day of pickup.

  2. Excluded Materials: Certain items are excluded from regular trash collection services ("Excluded Materials"), including but not limited to:

  • Hazardous waste, toxic substances, or regulated medical waste

  • Tires, mattresses, appliances/electronics, yard waste

  • Any materials requiring special handling for disposal

  • Items prohibited by law from disposal

The customer warrants that their waste does not contain Excluded Materials. Title to and liability for proper disposal of Excluded Materials always remains with the customer.

3. Billing and Payment Terms: AWS will bill the customer in advance on a periodic basis (e.g., monthly, quarterly, annually) for services. By accepting service, the customer agrees to pay the invoiced amount and continue service for the full billing period. Payment is due within 30 days of the invoice date. If payment is not received on time, late fees will be applied as specified on the invoice, up to the maximum allowed by law. Late fees consist of a $5 minimum charge plus interest of 1.5% monthly on overdue balances. Failure to pay invoices may result in suspension of service until the balance is paid in full. Reactivation fees may apply if service is suspended. Advance payments for monthly/quarterly services are non-refundable if service is terminated early, unless required by law. AWS reserves the right to increase rates periodically. Customers will be notified in advance of any rate changes and may choose to terminate service without penalty. Discounts on certain fees may be offered to customers enrolled in autopay or paperless billing. Additional service fees as published in the AWS price list may apply.

4. Service Changes: AWS reserves the right to modify the frequency, collection schedule, equipment provided, and service rates, with proper advance notice to the customer. Continued use of the service after notification of changes constitutes acceptance of the changes.

5. Cancellation Policy: The customer may cancel service at any time after completion of their current prepaid term. AWS will issue a prorated refund for any unused portion of a prepaid annual term. AWS may cancel service at any time if the customer violates the terms and conditions, with or without notice. Refunds will not be issued if service is cancelled due to customer violations.

6. Limitation of Liability: The liability of AWS is limited to direct damages arising from gross negligence or willful misconduct. AWS has no liability for any consequential or indirect damages suffered by the customer.

7. Dispute Resolution: In the event of a dispute, the parties agree to attempt informal resolution prior to escalation. If a dispute cannot be resolved informally within 30 days, either party may initiate binding individual arbitration conducted under JAMS Streamlined Arbitration Rules. The costs of arbitration will be covered by AWS, unless the customer does not prevail in their claim. Class action arbitration is expressly waived. Small claims actions are permitted as an alternative. The customer may opt out of the binding arbitration process by providing written notice within 30 days of starting service. If opted out, neither party is bound to arbitrate disputes.

8. General Provisions: AWS has no liability for failure to perform or delays caused by uncontrollable events. This agreement is governed by the laws of the State of Texas. Any changes must be in writing to be valid. As required by law, the customer has a right to cancel this agreement without penalty within 3 business days.

9. PRIVACY POLICY: Customer's privacy is important to Agile Waste Services (AWS). The information collected by AWS from Customer is used to provide the Services and may be shared with AWS's affiliates and partners as necessary to fulfill AWS's obligations under these Terms and Conditions. AWS takes reasonable measures to protect Customer's personal information but cannot guarantee its absolute security. Customer acknowledges and agrees that AWS may collect, use, store, and process personal information in accordance with AWS's Privacy Policy.
